National Labor Relations Board (NLRB) Issues Memo Addressing Compliance in Areas of NLRA and EEO Law Overlap

On 1/16/25, the General Counsel for the National Labor Relations Board (NLRB) issued a memo to all field offices on harmonizing the National Labor Relations Act (NLRA) and federal Equal Employment Opportunity (EEO) laws. The memorandum emphasizes that it is important to comply with both the NLRA and EEO laws and offers suggestions and examples. Specifically, the memo addresses work civility rules, confidentiality policies for investigations, and employee speech/conduct in the context of NLRA-protected activity that potentially implicates EEO laws.
