New Administration Fires Two Equal Employment Opportunity Commission (EEOC) Commissioners
On 1/29/25, the new Trump Administration discharged two (2) of the three (3) Democratic Commissioners on the five-seat Equal Employment Opportunity Commission (EEOC), including Charlotte Burrows, the chair of the Commission during the Biden administration (whose term was scheduled to expire on July 1, 2028), and Jocelyn Samuels, the vice chair of the Commission (who was to serve until July 1, 2026). Also fired was EEOC General Counsel Karla Gilbride, who was confirmed during the Biden administration for a four-year term ending in 2027. With only two members left (Lucas and Kotagal), the EEOC lacks a quorum, as it must have 3 commissioners to form a quorum. As a result, without a quorum, the EEOC cannot initiate formal rulemaking and cannot issue, modify, or revoke formal guidance.
