Cal. Court of Appeals Affirms Trial Court Granting of Writ Petition Challenging Suspension of Doctor's Privileges

On 2/19/25, in Lin v. Board of Directors of PrimeCare Medical Network, the Court affirmed the trial court's decision to grant a petition for writ of administrative mandamus under CCP 1094.5. The petition challenged the Board's decision in peer review proceedings after PrimeCare had suspended Lin's privileges to perform patient care services. The Court found that the Board acted in excess of its jurisdiction and committed a prejudicial abuse of discretion when it reversed Prime Care's judicial hearing committee finding Lin's suspension was unreasonable and not warranted.
