Cal. Court of Appeals Affirms Trial Court Ruling Refusing to Compel Arbitration Where Employee Waived Individual Claims and Proceeded Solely with PAGA Claims

On 2/26/25, in Rodriguez v. Packers Sanitation Services, the California Court of Appeals affirmed a trial court order denying an employer's motion to compel arbitration of an action brought under the California Private Attorneys' General Act of 2004 (PAGA).  The employer argued that the trial court failed to order the arbitration of the employee's individual claims, but the employee responded and argued that he had waived his individual relief and his PAGA claims therefore lacked an individual component.
