Court Denies Trump Administration’s Motion to Stay and Clarifies Injunction Against DEI

On 3/10/25, in National Association of Diversity Officers in Higher Education et al. v. Trump et al.,, the U.S. District Court for Maryland denied a motion to stay and clarified its 2/21/25 preliminary injunction against the Trump Administration's enforcement of executive orders (EOs) banning diversity, equity, and inclusion (DEI) programs across the federal executive branch. In 1/2025, the Trump Administration issued EOs prohibiting DEI initiatives within the federal government, for contractors, and recipients of federal funding. The EOs also directed federal agencies to investigate and take action against such practices by all employers. The district court’s 2/21/25 ruling granted a nationwide preliminary injunction prohibiting the Trump Administration from the EOs, pending further legal proceedings. The ruling addressed provisions in EOs 14151 and 14173, which involve terminating equity-related grants or contracts and enforcing the aspects of the EOs relating to the concept of “illegal DEI.”
