Cal. Court of Appeals Affirms Trial Court Ruling Denying Motion to Compel Arbitration of Individual PAGA Claims

On 4/8/25, in Ford v. the Silver F, Inc., the California Court of Appeals issued a ruling affirming a trial court's ruling denying a motion to compel arbitration of individual claims to recover penalties under the California Private Attorneys' General Act of 2004 ("PAGA") (Labor Code 2698, et seq.) The trial court denied the motion, finding that the arbitration agreement specifically excluded PAGA claims. After considering the language of the arbitration agreement and surrounding circumstances, the Court concluded that the trial court properly interpreted the agreement and denied the motion to compel arbitration.

In the "Inclusive Writing Guide," the NLRB advises that "disability" should be used instead of the word "handicap," and that the words "deficit," "defect," "abnormality," "problem," and "normal," should not be used. U.S. Equal Employment Opportunity Commission (EEOC)'s San Francisco District Appoints U.C. San Diego Alumni As Director

On 1/13/25, the  U.S. Equal Employment Opportunity Commission (EEOC) a ppointed  Christopher Green as  director of the agency’s San Francisco District.  Green previously worked  as a director in the agency’s Albuquerque and San Diego local offices.
